This website is operated by Relief Restorations Inc. Throughout the site, “Relief Restorations,” “we,” “us,” and “our” refer to Relief Restorations Inc. We offer this website and any related information, tools, and services (collectively, the “Site”) to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices contained or referenced here (these “Terms”).

By accessing or using any part of the Site, by contacting us through the Site, or by purchasing products or services from us, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Our e-commerce storefront, if and as offered, is hosted by Ecwid or Shopify (the “Store”). Ecwid or Shopify provides the online e-commerce platform that enables us to sell certain products or services to you. Additional terms from Ecwid, Shopify or other service providers may apply.

 

DEFINITIONS
“Services” means any inspection, testing, mitigation, abatement, remediation, cleanup, consulting, renovation, construction, demolition, or related works that Relief Restorations offers.
“Products” means physical items we sell.
“Client,” “you,” and “your” mean any user of the Site and any purchaser of our Products or Services.

 

ELIGIBILITY AND ACCOUNT RESPONSIBILITIES

You must be the age of majority in your province or territory of residence to use the Site or place orders. If you create an account, you are responsible for maintaining its security and for all activity under it. We may refuse service, close accounts, or cancel orders in our discretion.

 

WEBSITE USE AND RESTRICTIONS

We try to display Product colours and images accurately, but display variations may occur. Descriptions and specifications are subject to change, and we may discontinue any Product at any time.

 

BILLING, ORDERS, AND ACCOUNT INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all orders, and to promptly update your contact and payment details. We may cancel or limit quantities per person, household, or order and will attempt to notify you using the details provided at checkout.

 

RETURNS, REFUNDS, AND CANCELLATIONS
Our Returns/Refunds policy (linked from the Site) forms part of these Terms. For Services, deposits and cancellation terms are set out in your written estimate, work order, or service agreement; where not specified, deposits are non-refundable once scheduling and mobilisation begin, and time-and-materials already incurred are chargeable.

 

SERVICE ESTIMATES, CHANGE ORDERS, SITE CONDITIONS
Service estimates are based on limited, non-destructive observation and information available at the time. Hidden or unforeseen conditions (e.g., concealed mould, asbestos, structural or electrical issues, hazardous materials, or access restrictions) may require changes in scope, method, timeline, and price. You authorise reasonable change orders (written or electronic confirmation) for health, safety, or regulatory compliance. If you decline necessary changes, we may suspend or terminate work and invoice for work performed and costs incurred.

 

HAZARDOUS MATERIALS; ASBESTOS AND MOULD DISCLOSERS
You are responsible to disclose known or suspected hazardous materials (e.g., asbestos-containing materials, mould, lead, biological or chemical hazards) and pre-existing conditions. Unless expressly included in our written scope, identification, testing, abatement, or remediation of hazardous materials is excluded. Disturbance of suspect materials without proper testing and controls is prohibited. We may halt work if unsafe conditions exist. Sampling and laboratory analysis, if requested, will follow applicable standards; results are reported as provided by the lab.

 

SITE ACCESS, UTILITIES, AND SAFETY
You will provide safe, lawful, and timely access to the site; clear work areas; and necessary utilities (water, power, lighting, heat). You will secure pets, valuables, and sensitive contents. We will implement reasonable containment, PPE, ventilation, and safety controls consistent with our scope. Temporary inconveniences (noise, odour, restricted access) may occur. You agree to comply with our safety instructions while on site.

 

CONTENTS, PACK-OUTS, AND STORAGE
If contents handling or pack-out is included, we will catalogue and handle items with reasonable care. We are not responsible for pre-existing damage, inherent vice, or deterioration. Storage, if provided, may be at third-party facilities and subject to separate terms. Insurance for contents during transit or storage is your responsibility unless otherwise agreed in writing.

 

INSURANCE CLAIMS AND THIRD-PARTY CO-ORDINATION
We are not your insurer and do not guarantee coverage, scope approval, or payment by any insurer or third party. You are responsible for deductibles and any amounts not covered. We may, as a courtesy, provide estimates, photos, moisture maps, and reports; however, ultimate payment responsibility remains with you unless otherwise agreed in writing (e.g., valid and signed assignment of benefits, where permitted).

 

SCHEDULING, DELAYS, AND FORCE MAJEURE
Schedules are estimates. We are not liable for delays caused by events beyond our reasonable control, including severe weather, supply disruptions, permit delays, labour shortages, strikes, pandemics, power outages, or the discovery of hazardous conditions. If a force majeure event occurs, timelines will be extended and reasonable additional costs may apply.

EQUIPMENT RENTALS

Relief Restorations Inc. may, at its discretion, rent certain equipment (for example: air movers, dehumidifiers, air scrubbers, HEPA vacuums, heaters, or other restoration tools) to clients or contractors. All rentals are subject to the following conditions:

  1. Eligibility and Identification: Renter must be at least 18 years of age and provide valid government identification.

  2. Deposit and Payment: A refundable security deposit and full rental payment are required prior to pickup or delivery. The deposit may be applied toward repair or replacement costs for lost, damaged, or improperly returned equipment.

  3. Rental Period: Daily rental periods are based on 24-hour increments unless otherwise stated. Late returns may be charged at the daily rate until returned.

  4. Use and Responsibility: The renter is responsible for the proper operation, care, and safeguarding of the equipment. Equipment must be used only for lawful purposes and in accordance with manufacturer instructions.

  5. Damage, Loss, or Theft: The renter assumes full liability for loss, theft, damage, misuse, neglect, or improper operation during the rental period. The renter agrees to pay full replacement value for lost or irreparably damaged equipment.

  6. Return Condition: Equipment must be returned clean and in the same condition as received, subject to normal wear. Additional cleaning fees may apply for heavily soiled or contaminated returns.

  7. Inspection: All equipment is inspected and tested before and after each rental. Relief Restorations reserves the right to retain part or all of the deposit if equipment is returned damaged, contaminated, or incomplete.

  8. No Warranty: Rental equipment is provided “as is.” Relief Restorations is not responsible for loss of productivity, damage, or injury resulting from equipment failure or misuse.

  9. Indemnity: The renter agrees to indemnify and hold harmless Relief Restorations from any claims, injuries, or damages arising from the renter’s possession, use, or transportation of rented equipment.

FINANCING THROUGH FINANCEIT

Relief Restorations Inc. offers clients the option to apply for financing of eligible projects or purchases through FinanceIt, an independent third-party lender. The following terms apply:

  1. Third-Party Relationship: FinanceIt is not owned, controlled, or operated by Relief Restorations. All credit decisions, financing terms, and payment arrangements are made solely by FinanceIt in accordance with their policies.

  2. Application Process: By choosing to apply for financing, you will be redirected to FinanceIt’s secure platform to complete your application. Relief Restorations does not collect or store your financial information.

  3. Approval and Agreements: Approval, loan amount, interest rate, and repayment schedule are determined solely by FinanceIt. You are entering a financing agreement directly with FinanceIt, not with Relief Restorations.

  4. Payments: Once financing is approved, FinanceIt pays Relief Restorations for the financed portion of your project or purchase, and you make payments directly to FinanceIt according to their terms.

  5. Cancellations or Modifications: Any cancellations or project changes after funding must be managed through both Relief Restorations and FinanceIt. Refunds, if applicable, are subject to FinanceIt’s policies and our own cancellation terms.

  6. Liability: Relief Restorations is not responsible for any errors, delays, credit decisions, interest charges, or disputes arising from your financing arrangement.

PROJECT PHOTOS, VIDEOS, AND MEDIA USAGE

To maintain transparency, documentation quality, and training standards, Relief Restorations Inc. may capture photographs or videos before, during, and after project work.

  1. Purpose: Photos and videos are used for project documentation, quality assurance, insurance reporting, and internal record keeping.

  2. Privacy: We take great care to exclude personal identifiers such as faces, addresses, or private contents wherever possible.

  3. Marketing Use: With your written or electronic consent, de-identified images (showing only work areas or damage conditions) may be used in marketing materials, case studies, or online galleries to demonstrate our services.

  4. Confidential Locations: We will never publish identifiable addresses, names, or personal items without express permission.

  5. Ownership: All images and videos captured by Relief Restorations staff during work are considered company property and part of the project record.

PAYMENT TERMS
Unless otherwise set out in your agreement, deposits are due upon scheduling; progress invoices are due upon receipt; final invoices are due upon substantial completion. Late amounts may accrue interest at the lesser of 2% per month (24% per annum) or the maximum allowed by law, plus reasonable collection costs. We may suspend work or withhold reports until amounts due are paid.

 

PHOTOS, VIDEO, AND TESTIMONIALS
You consent to our reasonable collection of site photos, videos, moisture readings, and related documentation to provide Services, quality control, and for reporting to you and your insurer. With your separate written consent, we may use de-identified before/after imagery or testimonials for training and marketing. We will not publish personally identifying details without your permission.

 

OPTIONAL TOOLS AND THIRD-PARTY LINKS
We may provide access to third-party tools or link to third-party sites. These are provided “as is” and “as available” without warranties. We are not responsible for third-party materials, policies, products, or services. Review third-party terms before use.

GOVERNING LAW; DISPUTE RESOLUTION
These Terms and any related disputes are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without giving effect to conflict of laws rules. The courts located in Winnipeg, Manitoba will have exclusive jurisdiction, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. If permitted by applicable rules, the parties agree to bring qualifying claims in Manitoba Small Claims Court. You and we waive any right to a jury trial to the extent permitted by law.

These Terms, together with any Policies linked on the Site (including Privacy Policy and Returns/Refunds), and any signed estimate, work order, or service agreement between you and us, form the entire agreement regarding the Site, Products, and Services. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign these Terms as part of a merger, acquisition, or asset sale.

 

INTERPRETATION; DRAFTING
Headings are for convenience only and do not affect interpretation. Any ambiguities will not be construed against the drafting party. These Terms are available in English; if translated, the English version controls in case of conflict.
